Platform terms

1. What the platform is

app.simonbowen.com is the platform I use with my coaching and mentoring clients. It holds what happens between our sessions: the sessions we book, the reflections you complete, your goals, milestones and micro-actions, documents, messages and the summaries I write after a session. It's a place to arrange our work and keep a record of it.

Anyone can also open a free account to complete reflections for themselves.

2. Who these terms are between

These terms are between you and me, Simon Bowen, Weitzgrunder Allee 3, 14806 Bad Belzig, Germany. I run the platform myself, as a freelancer.

You accept these terms when your account is made, by ticking the box on the sign-up page.

3. The platform and our coaching agreement

If you're my client, our coaching agreement governs the coaching, and these terms govern your use of the platform. The platform is included in the coaching at no extra charge. You don't have to use it: we decide together at the discovery session whether it would help you.

4. Who can have an account

  • You need to be 18 or over.
  • Clients: if we decide to use the platform, I invite you by email, and you set a password when you accept.
  • Free accounts: anyone can open one with an email address and a password.
  • You don't need an account to answer a reflection someone sent you, or to book a call with me.
  • Only I have a coach account.

You sign in with your email address and password. If your account uses the same email address as your Google account, you can also sign in with Google.

5. How long you have access

Access to the platform is free for the duration of our coaching, and for as long after it has ended as you wish. If your account has been inactive for six months, I contact you with a view to deleting your data.

A free account that hasn't been used for 120 days is deleted, after a warning email at day 90 with a link to keep it.

6. What you can do on the platform

As my client, you can:

  • see our sessions, and book, move or cancel them within the times I make available;
  • complete the reflections I assign to you;
  • write your own goals, milestones and micro-actions, and mark them done yourself; I don't judge them;
  • upload documents you'd like me to know about;
  • send me messages;
  • read the summaries I publish after a session, and download them as a PDF;
  • take part in a 360° Feedback round I set up for you: you invite your raters and send them reminders, and you see the results once I publish them;
  • give and withdraw your consents;
  • close your account.

With a free account, you can:

  • complete reflections for yourself;
  • run your own 360° Feedback round;
  • compare a reflection with one person you invite (Share & Compare);
  • share a reflection through a link, or recommend it to someone by email;
  • write to me, and book a discovery call;
  • close your account.

7. Your content

What you write and upload stays yours. You allow me to store and process it to run the platform and our coaching, as my privacy policy describes.

When you share a reflection through a link, anyone who has the link can see it.

8. Fair use

You agree not to:

  • upload unlawful content, or content that infringes someone else's rights;
  • try to reach other people's data, or to get around the platform's security;
  • read the platform with automated tools, or overload it.

9. AI features

The platform's AI features are switched off. Before I switch them on, I'll update my privacy policy and these terms.

10. Availability

The platform is free, and I run it myself. I keep it available as well as I can, but I can't promise that it always will be. Where I can, I announce planned maintenance in advance.

11. Cost

The platform is free. For clients it's included in the coaching; a free account costs nothing. The platform takes no payments.

12. Liability

I'm liable without limit for damage I cause intentionally or through gross negligence, and for injury to life, body or health. For slight negligence, I'm liable only if I breach an essential obligation, meaning one that makes the use of the platform possible in the first place and on which you can rely, and then only for the typical damage that could be foreseen. My liability under the Product Liability Act is not affected.

13. Changes to these terms

I tell you about any change to these terms by email, at least 4 weeks before it applies. If you don't agree, you can close your account before then.

14. Closing your account

You can close your account at any time: "Close and delete my account" is in your settings, under Privacy & Consent.

  • A free account is deleted 14 days after you ask, unless you cancel in that time.
  • For a client account, I'm told of your request and carry it out. Your own content is deleted. I keep my coaching record without your name and contact details for 3 years from the end of the year in which our coaching ends.

Before you close your account, you can ask me for a copy of your data at privacy@simonbowen.com.

I may close an account with 4 weeks' notice by email, or at once if the account is used against section 8.

15. Right of withdrawal

If you use the platform as a consumer, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract is made, which is the day your account is made.

To exercise the right of withdrawal, you must inform me (Simon Bowen, Weitzgrunder Allee 3, 14806 Bad Belzig, Germany, sb@simonbowen.com) of your decision to withdraw from this contract by a clear statement, for example a letter sent by post or an email. You may use the model withdrawal form below, but it isn't obligatory.

To meet the withdrawal deadline, it's enough for you to send your notice before the withdrawal period has expired.

Effects of withdrawal. If you withdraw from this contract, I close your account and delete its data as my privacy policy describes. There's nothing to refund, because the platform is free.

Model withdrawal form. Complete and return this form only if you wish to withdraw from the contract.

16. Law

German law applies. If you're a consumer, you also keep the protection of the mandatory rules of the country where you live.
